Terms and Conditions

These Terms and Conditions (“Terms”) apply to all services provided by Mike James Mobile Mechanical (“we”, “us”, “our”) to customers (“you”, “your”). By engaging our services, you agree to be bound by these Terms.

1. Services Provided

We provide mobile and workshop-based mechanical repairs, servicing, diagnostics, and inspections for passenger and light commercial vehicles. All services are carried out by qualified technicians using professional-grade tools and equipment.

We reserve the right to refuse service if:

  • The vehicle presents a safety hazard

  • Accurate information is not provided by the customer

  • A safe and legal worksite cannot be provided for mobile jobs

2. Estimates, Quotes & Additional Work

  • All quotes are inclusive of GST, unless clearly stated otherwise

  • Quotes are valid for 14 calendar days

  • Quotes are based on the vehicle’s condition at the time of inspection or inquiry

  • If further issues arise during work, you will be contacted for approval before proceeding

  • Verbal or written approval is binding and billable

  • Quotes are estimates only, unless a fixed-price agreement is explicitly provided in writing

3. Payment Terms

  • Full payment is due immediately upon completion of work unless agreed otherwise in writing

  • We accept EFTPOS, credit card, and bank transfer

  • Vehicles will not be released or mobile work confirmed as complete until payment is received in full

  • Invoices overdue by 7+ days may incur 2% monthly interest and may be referred to debt recovery

  • In cases of non-payment, we may retain possession of the vehicle under lien until the balance is settled

4. Parts Policy

a. Parts Supplied by Us

  • We source new OEM or high-quality aftermarket parts that meet or exceed manufacturer standards

  • These parts are covered by a manufacturer’s warranty, typically 12 months, and protected by Australian Consumer Law (ACL)

  • If a supplied part fails due to a defect, we will repair or replace it at no charge, provided misuse or external damage is not involved

b. Second-Hand / Used Parts

  • We may use second-hand or reconditioned parts by request or where new parts are unavailable

  • Warranty on used parts is limited to what is offered by the supplier

  • Labour to remove or replace a failed used part is not covered under warranty, unless explicitly offered by the part supplier and agreed upon prior

  • We do not warrant second-hand parts for longevity or performance

c. Customer-Supplied Parts

  • Parts you supply are installed at your own risk

  • No warranty is provided on customer-supplied parts or the labour associated with fitting them

  • We do not verify compatibility or suitability of parts not sourced by us

  • If a customer-supplied part fails, you are liable for:

    • The cost of diagnosis

    • The cost of removing the part

    • Any additional damage caused

  • Labour to remove, refit, or troubleshoot faulty customer-supplied components is chargeable at standard rates

d. Ownership of Removed Parts

Unless requested in writing before work begins, all replaced or removed parts become our property and will be disposed of responsibly.

5. Warranty on Workmanship

All services include a 12-month or 20,000 km warranty (whichever comes first) on workmanship.

Warranty exclusions:

  • Misuse, neglect, or improper maintenance of the vehicle

  • Modifications or unauthorised repairs carried out by third parties after our service

  • Failures resulting from customer-supplied or second-hand parts

  • Ignoring repair recommendations

  • Contaminated fluids or fuels

All warranty claims must be inspected by us before approval. We reserve the right to determine the appropriate remedy.

6. Customer Responsibilities

You are responsible for:

  • Providing accurate vehicle history and fault details

  • Ensuring access to the vehicle (keys, flat surface, safe space for mobile jobs)

  • Approving work before it begins

  • Acting on advice about further repairs or maintenance

  • Collecting your vehicle within 3 business days of work completion for workshop jobs

7. Liability and Limitations

While we take great care in our work, we are not liable for:

  • Pre-existing faults or damage

  • Loss of time, income, or inconvenience caused by breakdowns or repair delays

  • Damage caused by defective customer-supplied or used parts

Under the Australian Consumer Law, if services do not meet consumer guarantees, our liability is limited to:

  • Re-performing the service, or

  • Paying the cost of having the service re-performed

8. Storage and Uncollected Vehicles

  • Vehicles must be collected within 3 business days of notice of completion

  • After that, a $25/day storage fee may apply

  • Vehicles uncollected after 30 days may be disposed of or sold under the Disposal of Uncollected Goods Act 2020 (QLD) to recover costs

9. Privacy Policy

We collect personal information only for the purpose of:

  • Communicating with you

  • Managing bookings, invoices, and warranties

  • Recording service history

We do not sell or share your data except where required by law. You may request access to your personal records at any time.

10. Amendments

We may update these Terms at any time. The latest version will always be available on our website. Continued use of our services implies acceptance of the most current version.
